This Privacy Policy applies to Personal Data (defined below) processed by Tow4Technologies, Inc. (“Tow4Tech,” “we,” “us,” or “our”) in the course of providing end-to-end roadside assistance services where truck companies, truck fleet management companies, and roadside assistance providers (collectively with its representatives, employees, service providers, and agents, the “Service Requester”) can use the technology provided by Tow4Tech to connect with tow truck service providers, tow dispatchers, tow truck operators, and other service providers (collectively with its representatives, employees, service providers, and agents, the “Service Provider”) to obtain towing services in case of an incident and/or other related services, as collected from our website (the “Site”), our iOS and Android apps including, but not limited to, Tow4Tech Service, Tow4Tech Roadside, Tow4Tech Dispatch, Tow4Tech Operator (the “Apps”), our related online service offerings, and any other communication or messaging services that we use from time to time (collectively with the “Site” and the “Apps”, the “Service” or the “Services”).

This Privacy Policy explains what Personal Data we collect, how we use and share that data, and your choices concerning our data practices. It also explains how we engage with Stripe to provide the Service to you.

Before using the Services or submitting any Personal Data to us, please review this Privacy Policy carefully and contact us at privacy@tow4tech.com if you have any questions. By using the Services, you agree to the practices described in this Privacy Policy. If you do not agree to this Privacy Policy, you may not access or use the Services.

1. Personal Data We Collect

We collect information that alone or in combination with other information in our possession personally identifies you (“Personal Data”) as follows:

Personal Data You Provide: We collect Personal Data when you visit the Site or Apps, register to use the Service, in connection with your use of the Service, and in other instances where you may provide Personal Data to us. During the registration process, you will be asked to consent to our Privacy Policy and Terms of Service. You will have the option to review these documents before giving your consent.  For certain features or Services that require additional data collection, we will provide you with a specific opt-in mechanism. For example, if you choose to enable location tracking for personalized recommendations, you will be asked to explicitly opt-in to this feature.

You have the right to withdraw your consent and opt-out of data collection and processing at any time. We provide the following opt-out mechanisms:

• Account Settings: You can manage your data preferences and withdraw consent for specific data collection and processing activities through your account settings in our Apps. This includes disabling features such as location tracking, marketing communications, and data sharing with third parties.
• Device Settings: You can control the app's access to your device features and data through your device settings. For example, you can disable location services or revoke camera access for our Apps through your device's privacy settings.
• Unsubscribe from Communications: If you have opted-in to receive marketing communications from us, you can unsubscribe at any time by clicking the "unsubscribe" link in the email or by adjusting your communication preferences in your account settings.

If you wish to withdraw your consent for any data collection or processing activities, you can do so by contacting us at privacy@tow4tech.com. Please note that withdrawing consent may affect your ability to use certain features of the app. We will process your request promptly and in accordance with applicable laws.

The Personal Data collected during these interactions may vary based on what you choose to share with us, but it will generally include your name, email address, mobile phone number, physical mailing and billing address, the location information (including GPS and WiFi data, IP address, and Bluetooth data) you and/or your vehicle, information about your driver’s license, insurance information, and information about your vehicle including, but not limited to, vehicle type, weight, and registration number, and photos. We may also collect certain payment and financial information in connection with the Service, including as necessary to ensure payments can be processed by our third-party payment processors, such as Stripe, Inc. (“Stripe”). Accordingly, in addition to this Privacy Policy and our Terms of Service, information related to your purchases is also processed according to Stripe’s Services Agreement and Privacy Policy.

Personal Data We Receive Automatically From Your Use of the Service: When you visit, use and interact with the Service, we may receive certain information about your visit, use or interactions. For example, we may monitor the number of people that visit the Service, peak hours of visits, which page(s) are visited, the domains our visitors come from (e.g., google.com, yahoo.com, etc.), and which browsers people use to access the Service (e.g., Google Chrome, Microsoft Internet Explorer, etc.), and geographical location information. In particular, the following information may be created and automatically logged in our systems:

• Log data: Information that your browser automatically sends whenever you visit the Service (“Log Data”). Log Data includes your Internet Protocol address, browser type and settings, the date and time of your request, and how you interacted with the Service.

• Device information: Includes name of the device, operating system, and browser you are using. Information collected may depend on the type of device you use and its settings.

Analytics: We may use certain third-party analytics providers, including Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help us analyze how users use the Service and enhance your experience when you use the Service. Online Tracking and Do Not Track Signals: We and any third-party service providers, as used from time to time, including Google, may use cookies, pixels or other tracking technologies to collect information about your browsing activities over time and across different websites following your use of the Service and use that information to send targeted advertisements. Our Service currently does not respond to “Do Not Track” (“DNT”) signals and operates as described in this Privacy Policy whether or not a DNT signal is received. If we do respond to DNT signals in the future, we will update this Privacy Policy to describe how we do so.

Your Choices. On most web browsers, you will find a “help” section on the toolbar. Advertising networks may collect Personal Data through the use of cookies. Most advertising networks offer you a way to opt out of targeted advertising. If you access the Service on your mobile device, you may not be able to control tracking technologies through the settings.

2. How We Use Personal Data

We may use Personal Data for the following purposes

• Personal Information: This may include but is not limited to your name, email address, phone number, and location data.
• Business Information: Information related to your tow truck services, such as company name, service areas, and types of services offered.Usage Data: Information on how you use our website and services, including preferences and feedback.

• To provide and facilitate your engagement with the Service, including to support, process and fulfill your purchase of products and services made available on the Service;
• If you are a Service Requester, we may share your Personal Data with the Service Provider;
• If you are a Service Provider, we may share your Personal Data with the Service Requester;
• To respond to your inquiries, comments, feedback, support requests, or questions;
• To send administrative information to you, for example, information regarding the Service, and changes to our terms, conditions, and policies;
• To analyze how you interact with our Service;
• To maintain and improve the content and functionality of the Service;
• To develop new products and services;
• To prevent fraud, criminal activity, or misuses of our Service, and to ensure the security of our IT systems, architecture and networks; and
• To comply with legal obligations and legal process and to protect our rights, privacy, safety or property, and/or that of our affiliates, you or other third parties.

Aggregated or Anonymized Information. We may collect or generate aggregated and/or anonymized Personal Data and use the aggregated and/or anonymized information to analyze the effectiveness of our Service, to improve and add features to our Service, and for any other lawful purpose. In addition, we may share aggregated and/or anonymized information with our business partners and other third parties. We may collect or generate aggregated and/or anonymized information through the Service, through cookies, and through other means described in this Privacy Policy.

Location-Based Personal Data. Our Apps collect Personal Data to enable location-based services even when the Apps are closed or not in use.  This data is used to us to provide the Services.  We are committed to protecting your privacy and ensuring the security of your location-based Personal Data.  Your location-based personal Data is protected in accordance with this Privacy Policy.  We do not share your location-based Personal Data with third parties, except as necessary to provide the Services or as otherwise required by law.

You can control the collection of your location-based Personal Data through your device settings.  However, please note that disabling location tracking may affect the functionality of certain features of the Apps and our ability to provide the Services.  To disable location tracking you can:

• Go to your device settings.
• Navigate to the app permissions.
• Toggle off the location permission for our Apps.

3. Sharing And Disclosure Of Personal Data

In certain circumstances we may share your Personal Data with third parties without further notice to you, unless required by the law, as set forth below:

• Vendors and Service Providers: To assist us in meeting business operations needs and to perform certain services and functions, we may share Personal Data with Service Requester or Service Providers, partners, vendors and service providers, including providers of hosting services, cloud services and other information technology services providers, ecommerce services, order fulfillment services, event management services, email communication software and email newsletter services, financial services providers and payment processors (including Stripe), customer relationship management and customer support services, and web analytics services (for more details on the third parties that place cookies through the Service, please see the “Cookies” section above). Pursuant to our instructions, these parties will access, process or store Personal Data in the course of performing their duties to us.
• Business Transfers If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of service to another provider, your Personal Data and other information may be shared in the diligence process with counterparties and others assisting with the transaction and transferred to a successor or affiliate as part of that transaction along with other assets.
• Legal Requirements: If required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, including to meet national security or law enforcement requirements, (ii) protect and defend our rights or property, (iii) prevent fraud, (iv) act in urgent circumstances to protect the personal safety of users of the Service, or the public, or (v) protect against legal liability.
• Affiliates: We may share Personal Data with our affiliates, meaning an entity that controls, is controlled by, or is under common control with Tow4Tech. Our affiliates may use the Personal Data we share in a manner consistent with this Privacy Policy.

4. Data Retention

We keep Personal Data for as long as you use the Service or as reasonably necessary or advisable to fulfill the purpose(s) for which it was collected, provide the Service, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, protect against fraud, enforce our agreements, and comply with applicable laws.

5. User Rights

Right to Access. You have the right to access the Personal Data we hold about you. You can request a copy of your personal data by contacting us at  privacy@tow4tech.com. We will provide you with a copy of your Personal Data in a structured, commonly used, and machine-readable format within thirty (30) days of receiving your request.

Right to Correct. If you believe that any Personal Data we hold about you is incorrect or incomplete, you have the right to request that we correct or update it. Please contact us at privacy@tow4tech.com with the details of the corrections needed. We will respond to your request within thirty (30) days.

Right to Deletion. You have the right to request the deletion of your Personal Data under certain circumstances, such as when the data is no longer necessary for the purposes for which it was collected or if you withdraw your consent (where applicable). To request the deletion of your Personal Data, please contact us at  privacy@tow4tech.com. We will respond to your request within  thirty (30) days and will take reasonable steps to delete your data unless we are required to retain it by law or for legitimate business purposes.

Right to Restrict Processing. You have the right to request that we restrict the processing of your Personal Data under certain conditions, such as when you contest the accuracy of the data or object to our processing. To request a restriction, please contact us at privacy@tow4tech.com. We will respond to your request within thirty (30) days and will inform you of the outcome.

Right to Data Portability. You have the right to data portability, which allows you to obtain and reuse your Personal Data for your own purposes across different services. Upon your request, we will provide you with your Personal Data in a structured, commonly used, and machine-readable format, or transmit it directly to another data controller where technically feasible. Right to Object to Processing. You have the right to object to our processing of your Personal Data on grounds relating to your particular situation, at any time. If you object, we will no longer process your Personal Data unless we can demonstrate compelling legitimate grounds for the processing or if it is needed for legal claims. Right to Withdraw Consent. Where our processing of your Personal Data is based on your consent, you have the right to withdraw your consent at any time. Withdrawing consent will not affect the lawfulness of processing based on consent before its withdrawal. To withdraw consent, please contact us at privacy@tow4tech.com.  

Exercising Your Rights. To exercise any of your rights, please contact us at privacy@tow4tech.com.  We may need to verify your identity before processing your request to ensure the security of your personal data. We will respond to all legitimate requests within thirty (30) days.  If your request is particularly complex or if you have made multiple requests, it may take us longer to respond. In such a case, we will notify you and keep you updated on the progress.

Complaints. If you are not satisfied with our response or believe we are processing your personal data in violation of applicable laws, you have the right to lodge a complaint with the relevant supervisory authority..  

6. Children

Our Service is not directed to children who are under the age of 18. Tow4Tech does not knowingly collect Personal Data from children under the age of 13. If you have reason to believe that a child under the age of 13 has provided Personal Data to us through the Service, please contact us at privacy@tow4tech.com and we will promptly delete that information from our databases.

7. Links to Other Websites and Third Party Functionality

The Service may contain links to other websites or applications, or other functionality not operated or controlled by Us, including certain banking or financial services (“Third-Party Services”). You will generally have discretion and control over the Third-Party Services with whom you elect to interact and share your Personal Data, except as otherwise provided in this Privacy Policy. These Third-Party Services include certain payment processors or other API finance solutions, such as Stripe. The information that you share with Third-Party Services will be governed by the specific privacy policies and terms of service of the Third-Party Services and not by this Privacy Policy. By providing these links or functionality we do not imply that we endorse or have reviewed these services. Please contact the Third-Party Services directly for information on their privacy practices and policies.

8. Security

You use the Service at your own risk. We implement commercially reasonable technical, administrative, and organizational measures designed to protect Personal Data both online and offline from loss, misuse, and unauthorized access, disclosure, alteration or destruction. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e-mail sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the Service or e-mail. Please keep this in mind when disclosing any Personal Data to us via the Internet. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Service, or third-party websites.

9. Your Choices

In certain circumstances providing Personal Data is optional. However, if you choose not to provide Personal Data that is needed to use some features of our Service, you may be unable to use those features. 10. Changes to the Privacy Policy

The Service, and our business may change from time to time. As a result, we may change this Privacy Policy at any time. When we do, we will post an updated version on this page, unless another type of notice is required by the applicable law. By continuing to use our Service or providing us with Personal Data after we have posted an updated Privacy Policy, or notified you by other means if applicable, you consent to the revised Privacy Policy and practices described in it.
